Australia’s most senior Catholic cleric, Cardinal George Pell, has been convicted of sexually abusing two choirboys while he was archbishop of Melbourne.

*The abuse occurred at Melbourne’s St Patrick’s Cathedral in 1996.

*Pell pleaded not guilty, and his lawyer has indicated he will launch an appeal against the conviction.

*Pell was convicted in December but details of the trial can only now be made public after a suppression order was lifted.




Ahead of his sentencing next week Pell will spend time behind bars, thousands of kilometres and a literal world away from his former home at the Vatican.




Pell was a year into his job as the head of the Vatican Secretariat for the Economy when the former choirboy first spoke to Victoria Police in 2015.

He told police he was sexually abused twice by Pell at St Patrick’s Cathedral in East Melbourne soon after the cardinal was installed as archbishop of Melbourne in 1996.

The most serious allegation was that Pell had forced the choirboy to perform a sex act on him after abusing his friend.

Pell’s victim cannot be identified and his evidence was given in a closed court, which means journalists and the public were excluded.

But his testimony can be gleaned from parts of the transcript read by the prosecution and defence during the trial.

The court was told he had been a student at the prestigious St Kevin’s College in Toorak and sang in the St Patrick’s Cathedral choir as part of a music program run by the school.

After singing at a Sunday mass in late December 1996, he and another choirboy slipped away from the rest of the group as they proceeded back to their rehearsal room.

He told the court that they came across the priest’s sacristy, a room at the rear of the cathedral used by priests to dress. It was off limits to the choir.

The former choirboy said they “were being naughty kids having a look around” when they came across a bottle of altar wine and started having a few swigs.

But soon, Pell appeared in the doorway, alone and dressed in his archbishop’s robes.

“He ... said something like ‘what are you doing in here?’ or ‘you’re in trouble’,” his victim told the trial.

The court heard one of the boys asked: “Can you let us go? We didn’t do anything”.

But instead, the then-archbishop pulled one of the boys aside and pushed his head down to his penis.

After a few minutes, he moved onto the other choirboy. Pell forced him to perform oral sex before fondling him as he masturbated.

“I put my clothes back on, I corrected myself,” the former choirboy told the jury, estimating the ordeal had lasted just minutes.

“We got up and left the room and went back into the choral change room area.”

Months later, the former choirboy was abused by Pell again.

After another Sunday mass, the archbishop pushed him against a corridor wall and groped him in a brief assault.

*Cardinal George Pell was convicted of one count of sexual penetration with a child under the age of 16, and four counts of an indecent act with or in the presence of a child under the age of 16.


*The December 2018 jury took over three days to find Cardinal Pell guilty of orally raping a 13 year old choirboy and molesting another chorister after a Sunday Solemn Mass at St Patrick’s Cathedral in 1996.




Excerpts of VICTIM'S TESTIMONY were read into open court by Crown Prosecutor Mark Gibson SC, and can now be published [suppression order has been lifted after second trial] ~~~



“[Pell] planted himself in the doorway and said something like ‘what are you doing here’ or ‘you’re in trouble’,” the victim told the jury.

.... [the Victim] said Pell controlled his friend’s head but he couldn’t see where Pell’s penis was.

The victim then described his own abuse at the hands of Pell ~~~


“It occurred closer to the corner of the room where the cupboards were,” ...

“I was pushed down and crouching or kneeling,” .... “Archbishop Pell was standing. He was erect and he pushed it into my mouth. I was pushed onto the penis.”


“He instructed me to undo my pants and take off my pants, and I did that. Then he started touching my genitalia, masturbating or trying to do something with my genitalia,” the chorister told the court.

“Archbishop Pell was touching himself on his penis with his other hand.”


Starry / Fiery: A further charge of an indecent act related to another incident in February 1997 where Pell pushed the surviving choirboy against a wall and touched his genitals in an incident lasting two or three seconds.

“I haven’t got good statistics on the reasons for those suicides,” he declared. “If they are connected with homosexuality, it is another reason to be discouraging people going in that direction. Homosexual activity is a much greater health hazard than smoking.”

The world can now know that a little over 20 years ago, in Pell’s first months as archbishop of Melbourne, this scourge of sex was forcing choirboys to suck his penis.

Cardinal George Pell, Pope Francis’ top financial adviser and the Vatican’s economy minister, bowed his head but then regained his composure as the 12-member jury delivered unanimous verdicts in the Victoria state County Court on December 11 after more than two days of deliberation.

The court had until Tuesday forbidden publication of any details about the trial.

Pell faces a potential maximum 50-year prison term after a sentencing hearing that begins on Wednesday. He lodged an appeal last week against the convictions.

Details of the trial had been suppressed because until Tuesday, Pell had faced a second trial in April on charges that he indecently assaulted two boys aged nine or 10 and 11 or 12 as a young priest in the late 1970s.

Prosecutor Fran Dalziel told the court on Tuesday that those charges had been dropped and asked for the suppression order to be lifted.

As with the erroneous conviction of Archbishop Philip Wilson this verdict will also be overturned on Appeal.

The 68-year-old was sentenced to 12 months' imprisonment last May and had spent four months in home detention at his sister's house.
He was one of the highest-ranking church officials convicted of covering up child abuse.
"There is no proper basis upon which I can rely to reject the evidence of the appellant," Judge Roy Ellis said before he handed down the ruling.
The judge noted "inconsistencies" with the accuser's statements regarding an alleged conversation he had with Mr Wilson about the abuse.

* Neither victim reported the abuse at the time but that does not mean it didn't happen. Mr Gibson quoted the surviving complainant who said it 'took a courage much later in life' to even consider speaking out. He feared jeopardising his scholarship to the prestigious St Kevin's College, making things difficult for his parents and struggled to understand what had happened and if it was 'normal'.

So this anonymous individual has no one who can corroborate his story?

There are no witnesses to an event that supposedly happened decades ago.

Its basically his word against Cardinal Pell

Nope this is a clear case of a Miscarriage of Justice

After the harrowing cases we saw in the UK with the wrongful convictions of the Birmingham Six, the Guilford Four and the Maguire Seven we should know all about what can happen when prejudice and hate against a group can override rational Judgement.

The Defense Argument:

DEFENCE - KEY ARGUMENTS

Barristers Robert Richter QC and Ruth Shann told the court:

* The prosecution timeline relied on 10 'independently impossible' events involving 40 or more people occurring within the same 10-minute window in order for the events to have happened and gone unnoticed. That includes: the two 13-year-old boys slipping away from the middle of the post-mass procession without being seen; Pell being alone and robed in the sacristy and not on the cathedral steps; and there being no other priests or altar servers moving between the sanctuary and priest's sacristy as was their practice after mass.

* It would have been 'inhumanly possible' for Pell to expose his penis to the boys while wearing the Archbishop's robes. The ensemble was made up of the alb, an ankle-length white under-tunic which included two slits to allow access to pockets, locked into place around the waist with a knotted rope cincture. A decorative chasuble was worn over top and, on special occasions a dalmatic as well. Pell required help robing and disrobing and Pell's master-of-ceremonies recalled only twice in five years not assisting.

* The surviving complainant's memories aren't of real events, but are a far-fetched fantasy that he, now aged in his 30s, may have come to believe as the truth. Mr Richter pointed to the fact neither victim came forward immediately, that the complainant who has since died denied being abused when asked directly by his parents, and that after the first incident involving both boys the surviving complainant did not warn his friend when he was later abused again.


So to reiterate its one person's word against another with no other witnesses over an event that supposedly happened two decades ago.

There is no way in a normal Court of Law that this would or should have resulted in a conviction.

I know people say this all the time but these guys should be instantly castrated as well as prison time..if they die in the process due to old age well F***them .
Realistically when he goes to prison , he is going to go to a cushy place where he will be looked after and kept away from the media etc ..but he will have it easy

Several cardinals and bishops told the summit that the Vatican should start publishing its secret files.

"One of the things you could be transparent about is the over 6,000 priests whose names have been delivered to the Vatican because they're child abusers," Mr Saviano said [survivor Phil Saviano].

"Who are these men, where are they today? What were their assignment records?"

Archbishop Coleridge told ABC News that the Vatican had files on Australian priests accused of abusing children.

He said he had "not the faintest idea" how many Australian cases were among a trove of allegations sitting with Vatican investigators.

But he said he would urge the Vatican to expedite the investigations.

"Justice delayed is justice denied and some of these processes take a very long time here," he said.

"I have to say that survivors have been asking for this for a very long time. It's taken us a long time to listen and take it on board."

Investigators in the Vatican admit transparency has been lacking in the decades since more and more abuse allegations have been referred to the Holy See.

Asked if the Church had compiled data on its volumes of abuse investigations and documents, Archbishop Charles Scicluna of Malta said no.
